PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS WHEN USING WEBSITES UNDER THE DOMAIN LETSHELPYOU.CO.UK (THE “SITE”). BY USING THIS WEBSITE AND THE SERVICES CONTAINED THEREIN YOU AGREE TO COMPLY WITH AND BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS (THE “TERMS”). IF YOU DO NOT AGREE TO AND ACCEPT THESE TERMS, YOU SHOULD NOT USE THE SITE.

YOUR ATTENTION IS DRAWN IN PARTICULAR TO CLAUSE 9 (WARRANTY) AND CLAUSE 10 (LIABILITY).

  1. 1 INTRODUCTION
    1. 1.1 “We”, “Our” and “Us” refer to the Council of the Borough of Kirklees ( the “Council”) of the Town Hall, Ramsden Street, Huddersfield, West Yorkshire, HD1 2TA and “You” and “Your” refers to the Landlord / Host or Tenant / Lodger of the properties, as applicable, using the Site.
    2. 1.2The “Site” has been developed and is managed by the Council working in partnership with Our “Local Authority Partners”. An up-to-date list of Our Local Authority Partners can be found here. You can contact us here.
    3. 1.3These Terms are deemed to include Our privacy policy
    4. 1.4When You Use the Site You agree to be bound by these Terms.
    5. 1.5Certain Uses of this Site are prohibited and amount to a misuse of Our systems and the Site. Please refer to clause 3.
    6. 1.6You may print and keep a copy of these Terms. They are the terms of the legal agreement between Us and You and can only be modified with Our consent. We reserve the right in Our sole discretion to change these Terms at any time without prior notice to You. Any changes will be posted on the Site and become effective at the time of posting. Your continued use of the Site and signing on after the effective date of such changes will constitute acceptance of an agreement to any such changes. We reserve the right to modify, suspend or discontinue all or part of the services to be provided at any time to You with or without notice. We shall not be liable to You or any other person should We exercise Our right to modify, suspend or discontinue all or part of the services provided.
  2. 2 INTELLECTUAL PROPERTY
    1. 2.1The copyright and all other intellectual property rights on the Site (including all database rights, trademarks, service marks, trading names, text, graphics, logos, code, files and links) belong to the Council. Subject to clause 3, You may download Material from this Site for the sole purpose of using this Site. However, You must not copy, transmit, modify, republish, store (in whole or in part), frame, pass-off or link to any material or information on or downloaded from this Site without the prior written consent of the Council.
    2. 2.2The Site may contain links to websites operated by third parties. We have no control over their individual content. We therefore make no warranties or representations as to the accuracy or completeness of any of the information appearing in relation to any linked websites. The links are for Your convenience only. We do not recommend any products or services advertised on those websites. If You decide to access any third party website linked from this Site, You do so at Your own risk.
    3. 2.3 The details of the properties / rooms available on this Site are provided to us by individual landlords, Hosts (that is someone living in the property who may or may not be the homeowner) or lettings agents acting on behalf of landlords and are provided for Your information only. We cannot verify these details and therefore make no warranties or representations as to their accuracy or completeness. If You rely on these details, You do so at Your own risk.
    4. 2.4By submitting content onto the Site or otherwise providing content to Us in connection with the services provided ('Materials'), You grant Us a royalty-free, perpetual, irrevocable and non-exclusive right and license to (a) Use, reproduce, distribute, display, modify and edit these Materials in connection with the services provided and (b) sublicense these rights. We will not pay You any fees for these Materials and reserve the right in Our sole discretion or on the instruction of one of Our Local Authority Partners to remove or edit them at any time. You also warrant and represent that You have all rights necessary to grant Us these rights. We permit You to post Materials on the Site provided that the content is not illegal, obscene, abusive, threatening, defamatory or otherwise objectionable to Us.
  3. 3 YOUR OBLIGATIONS AND CONDUCT
    1. 3.1You accept that You are solely responsible for ensuring that any information provided by You is true, accurate, current and complete. It is Your responsibility to update and inform Us of any changes to any of the details You provide. Any changes in circumstances should be updated as soon as reasonably possible.
    2. 3.2You agree not to publish any Material that is, or may encourage, a breach of any relevant laws or Regulations.
    3. 3.3You accept that You are solely responsible for ensuring that Your computer system meets all relevant technical specification necessary to use the Site and that Your computer system is compatible with this Site.
    4. 3.4You must not misuse Our system or this Site. In particular, You must not hack into, circumvent security or otherwise disrupt the operation of Our system and the Site, or attempt to carry out any of the foregoing.
    5. 3.5You must not use or attempt to use any automated program (including, without limitation, any spider or other web crawler) to access Our system or this Site, or to search, display or obtain links to any part of the Site, other than the relevant “Local Authority Partner” home page under the letshelpyou.co.uk domain, unless the automated program identifies itself uniquely in the User Agent field and is fully compliant with the Robots Exclusion Protocol (a "Permitted Program"). Any such use or attempted use of an automated program (other than a Permitted Program) shall be a misuse of Our system and this Site. Obtaining access to any part of Our system or this Site by means of any such automated programs (other than a Permitted Program) is strictly unauthorised.
    6. 3.6You must not upload or use inappropriate or offensive language or content or solicit any commercial services in any communication, form or email You send or submit from or to the Site.
    7. 3.7You must not include links to this Site in any other website without Our prior written consent. In particular (but without limiting the foregoing) You must not include in any other website any "deep link" to any page on this Site other than the relevant “Local Authority Partner” home page under the letshelpyou.co.uk domain without the prior written consent of the Council.
    8. 3.8You agree that you will not publish information on the Site in such a way as to discriminate against any particular nationality, racial, ethnic, or religious group, sexual orientation, age, gender or disability.
  4. 4 LANDLORD / HOST REGISTRATION & UPLOADING PROPERTY / ROOM DETAILS
    1. 4.1 To register as a Landlord / Host on the Site You must be 18 years of age or older.
    2. 4.2To upload properties or a room available advert and take full advantage of all features on the Site You must first submit a completed registration form to Us. At Our absolute discretion or that of Our Local Authority Partners, we may refuse Your application for registration. If we accept Your application for registration we will confirm this by sending You a verification email containing a link to complete Your registration.
    3. 4.3Each registration is for a single Member only. You may not share Your username and password with any other person nor with multiple users on a network.
    4. 4.4Only properties / rooms within the administrative boundaries covered by Our Local Authority Partners may be advertised via the Site. Landlords / Hosts with properties / rooms outside Our Local Authority Partners’ boundaries will not be able to promote those properties / rooms until such time that Letshelpyou is extended to those relevant areas of the UK.
    5. 4.5You undertake that all information provided by You for the purposes of registering with Us is true, accurate, current and complete. It is Your responsibility to update any changes to the details provided on registration.
    6. 4.6You undertake that all information provided by You for the purposes of advertising Your property / properties / spare room on the Site is true, accurate, current and complete. It is Your responsibility to update any changes to the details provided when uploading property / room information. In particular, it is Your sole responsibility to ensure that occupied properties / rooms are flagged as such on the Site.
    7. 4.7You accept sole responsibility for Your use of the Site and for keeping secret any username and password that may have been given to You or chosen by You for use on the Site. You will notify us immediately of any unauthorised use of them or any other breach of security of this Site of which You become aware.
    8. 4.8By registering on the Site You agree that We can send You notifications about Your account in addition to other Letshelpyou services and features. You also agree that We or a third party commissioned by Us may contact You on Our behalf to undertake market research on the use of Letshelpyou and that you will provide information to any reasonable request.
    9. 4.9By creating and activating a property / room available advert You give Your express permission for Your preferred contact details to be shared with Tenants / Lodgers who may wish to contact You to make further enquiries about Your advertised vacancy. We do not monitor or manage these communications and We are only hosting the website.
  5. 5 TENANT REGISTRATION
    1. 5.1Although certain parts of the Site may be used by anyone who visits without requiring registration, some of the services provided require You to register in order to enable Us to verify Your identity. To view full details of properties on this Site, including landlord contact details, You must submit a completed registration form to Us and become a Member. At Our absolute discretion, we may refuse Your application for registration. If we accept Your application for registration, we will confirm this by sending You a verification email containing a link to complete Your registration. Each registration is for a single Member only. You may not share Your Username and password with any other person nor with multiple users on a network.
    2. 5.2You undertake that all information provided by You for the purposes of registering with Us is true, accurate, current and complete. It is Your responsibility to update and inform Us of any changes to the details provided on registration.
    3. 5.3You accept sole responsibility for Your use of the Site and for keeping secret any username and password that may have been given to You or chosen by You for use on the Site. You will notify Us immediately of any unauthorised Use of them or any other breach of security of this Site of which You become aware.
    4. 5.4By registering on Site You agree that We can send You notifications about Your account in addition to other Letshelpyou services and features. You also agree that We or a third party commissioned by Us may contact You on Our behalf to undertake market research on the use of Letshelpyou and that You will provide information to any reasonable request.
  6. 6 LODGER REGISTRATION & ROOM WANTED ADVERT DETAILS
    1. 6.1 To register as a Lodger on the Site You must be 18 years of age or older.
    2. 6.2 To upload a Room Wanted advert and take full advantage of all features on the Site You must first submit a completed registration form to Us. At Our absolute discretion or that of Our Local Authority Partners, we may refuse Your application for registration. If we accept Your application for registration we will confirm this by sending You a verification email containing a link to complete Your registration.
    3. 6.3 Each registration is for a single Member only. You may not share Your username and password with any other person nor with multiple users on a network.
    4. 6.4 You undertake that all information provided by You for the purposes of registering with Us is true, accurate, current and complete. It is Your responsibility to update any changes to the details provided on registration.
    5. 6.5 You undertake that all information provided by You for the purposes of advertising Yourself and Your specific requirements via a Room Wanted advert on the Site is true, accurate, current and complete. It is Your responsibility to update any changes to the details provided when uploading information about Yourself and Your specific requirements. In particular, it is Your sole responsibility to ensure that Your Room Wanted advert is withdrawn from the Site once You no longer require a room.
    6. 6.6 You accept sole responsibility for Your use of the Site and for keeping secret any username and password that may have been given to You or chosen by You for use on the Site. You will notify us immediately of any unauthorised use of them or any other breach of security of this Site of which You become aware.
    7. 6.7 By uploading and activating a Room Wanted advert on the Site You agree that Hosts searching for Lodgers can contact You as a prospective Lodger.
    8. 6.8 By registering on the Site You agree that We can send You notifications about Your account in addition to other Letshelpyou services and features. You also agree that We or a third party commissioned by Us may contact You on Our behalf to undertake market research on the use of Letshelpyou and that you will provide information to any reasonable request.
    9. 6.9 By creating and activating a Room Wanted advert You give Your express permission for Your preferred contact details to be shared with potential Hosts who may wish to contact You to Your requirements in relations to their Room Available vacancy. We do not monitor or manage these communications and We are only hosting the website.
  7. 7 ADDITIONAL FEATURES FOR RENT-A-ROOM HOSTS & LODGERS
    1. 7.1 This section of these Terms only applies to Members of the Site who are acting as Hosts or Lodgers. If You have registered as a Host or Lodger account on the Site, You may also elect to take advantage of some of the additional features and services the Site offers as described in this section of these Terms.
    2. 7.1.1 Rent-A-Room Lodger Agreement - We always recommend that You enter into a Lodger Agreement when acting as a Host (live-in landlord). A Lodger Agreement is available to download from our Site here. Please note: The Lodger Agreement has been provided by a third party. We cannot be held responsible for any failure or deficiency in such agreements and any reliance You place on them is entirely at your own risk. You are advised to make your own inquiries and check that the agreement is suitable for your needs before entering into any legally binding commitment.
    3. 7.1.2 Rent-A-Room Host and Lodger Advice & Information – We offer an Advice & Information section on the Site that We think a Host (live-in landlord) and Lodger will need to read before entering into any legally binding commitment.
  8. 8 BARRING FROM THE SITE
    1. 8.1We reserve the right to bar users and/or Members from the Site and/or restrict or block their access or use of any and all elements of the services provided on a permanent or temporary basis at Our sole discretion or on the request of Our Local Authority Partners. Any such user and/or Member shall be notified and must not then attempt to use this Site under any other name or through any other Member.
    2. 8.2 Failure to meet any of the obligations or conditions below may lead to property / room / Room Wanted adverts listed on the Site being removed or suspended or a Member’s account being terminated by an administrator. The administrator’s decision is final:
      1. 8.2.1 If You let or manage properties as Your business You need to comply with the requirements of Consumer Protection Regulations. A summary of key requirements and more detailed guidance is available on the .Gov website.
      2. 8.2.2 If You are a Licence holder or manager of property licenced under the Housing Act 2004 (2004 Act) You must meet the fit and proper persons test the 2004 Act. You will have been informed by a local Council if You do not meet this requirement.
      3. 8.2.3 It is expected that properties advertised meet relevant minimum legal requirements. A quick checklist of what is required is provided on this site: Minimum Property Standards Checklist
    3. 8.3 A Person advertising properties has not or is not subject to any of the following in relation to Housing related law:
      - been convicted in the last five years
      - accepted a Simple Caution in the last two years
      - have formal legal notices outstanding or pending; or
      - an investigation in criminal offences
  9. 9 WARRANTY
    1. 9.1Whilst We endeavour to ensure that any Material available for downloading from the Site is not contaminated in any way, we do not warrant that such material will be free from infection, viruses and/or similar code.
    2. 9.2We strive to ensure that the Site and the services provided are available to You at all times but cannot guarantee that either the Site or the services will operate continuously without interruptions or be fault free. On occasion, necessary maintenance or upgrade work requires us to make the Site and the services provided unavailable without notice but We aim to keep downtime to a minimum. We shall not be liable if We cannot process Your details due to circumstances beyond Our reasonable control.
    3. 9.3The information provided on this Site is for general interest only and does not constitute specific advice. Whilst We endeavour to ensure that the information on the Site is accurate, complete and up-to-date We make no warranties or representations that this is the case.
    4. 9.4We make no warranty or guarantee that the Site or information available over it complies with laws other than those of England.
  10. 10 LIABILITY
    1. 10.1Nothing in these Terms will be deemed to exclude Our liability to You for death or personal injury arising from Our negligence, or for fraudulent misrepresentation.
    2. 10.2Subject to clause 10.1, we will not be liable for any failures due to software or Internet errors or unavailability or any other circumstances beyond Our reasonable control.
    3. 10.3Subject to clause 10.1, We do not accept any liability for loss of Your username or password caused by a breakdown, error, loss of power or otherwise caused by or to Your computer system.
    4. 10.4We may put in place such systems as We from time to time see fit to prevent automated programs being used to obtain unauthorised access to Our system and the Site. You are not permitted to use automated programs for such purposes and any such use or attempted use by You of such automated programs is at Your own risk. Subject to clause 10.1, We shall not be liable to You for any consequences arising out of or in connection with any such use or attempted use of automated programs to obtain unauthorised access to Our system or the Site.
    5. 10.5Subject to clause 10.1, We accept no liability for any loss suffered as a result of Your use of this Site or reliance on any information provided on it and exclude such liability to the fullest extent permitted by law.
    6. 10.6Subject to clauses 10.1 to 10.4 inclusive, We shall not be liable to You for:
      1. 10.6.1any indirect, consequential, special or punitive loss, damage, costs and expenses;
      2. 10.6.2loss of profit;
      3. 10.6.3loss of business;
      4. 10.6.4loss of reputation;
      5. 10.6.5depletion of goodwill; or
      6. 10.6.6loss of, damage to or corruption of data.
    7. 10.7When You use this Site to obtain contact details of a Landlord / Host / Tenant / Lodger we do not accept any liability for any subsequent communications that either Tenant / Lodger or Landlord / Host receive directly from one another.
  11. 11 LEGAL JURISDICTION
    1. 11.1English law shall apply to these Terms. You irrevocably agree that the courts of England will have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms and for those purposes irrevocably submit all disputes to the exclusive jurisdiction of the English courts.
  12. 12 DISCLAIMER
    1. 12.1Property / room descriptions and other information provided on the Site are intended for information and marketing purposes and whilst displayed in good faith, under no circumstances will We or Our Local Authority Partners accept responsibility for their accuracy. It is the responsibility of Tenants / Lodgers to satisfy themselves as to the accuracy of any property / room descriptions and the responsibility of landlords / hosts to ensure the accuracy of any descriptions provided. We do not inspect or personally recommend any of the properties or rooms that feature on our Site. We strongly advise you to inspect properties thoroughly before you make any binding commitments in respect of any properties or rooms listed on our Site.
    2. 12.2The LHA Calculator provides an indication of the maximum allowance You could receive but no warranties are provided in respect of the said allowances. You should seek advice from Your local authority housing benefits office for confirmation of Your Local Housing Allowance before You sign a tenancy agreement.
  13. 13 CUSTOMER FEEDBACK AND QUALITY
    1. 13.1We operate a system to ensure that all customer feedback is dealt with fairly and consistently. We welcome any suggestions that You make about how we may improve Our services. Please contact Us here feedback@letshelpyou.co.uk. We aim to acknowledge all customer feedback.
  14. 14 GENERAL
    1. 14.1The headings in these Terms are solely used for convenience and have no legal or contractual significance
    2. 14.2These Terms are the whole agreement between You and Us. You acknowledge that You have not entered into this agreement in reliance on any warranty or representation made by Us (unless made fraudulently). If a court decides that any part of these Terms cannot be enforced, that particular part of these Terms will not apply but the rest of these Terms will. A waiver by a party of a breach of any provision shall not be deemed a continuing waiver or a waiver of any subsequent breach of the same or any other provisions. Failure or delay in exercising any right under these Terms shall not prevent the exercise of that or any other right. You may not assign or transfer any benefit, interest or obligation under these Terms. The provisions of the Contracts (Rights of Third Parties) Act 1999 shall not apply to these Terms.
    3. 14.3At all times the Council shall process any information obtained in accordance with the provisions of the Data Protection Act 2008.
